If
you have purchased trees from Ruppert Nurseries before then you are
no doubt acquainted with our conditions of sale, which are fairly
standard with the industry. For those of you who are not familiar
with our sales terms, they are as follows:

As an express condition of each sale, it is agreed that we will exercise reasonable
care to insure that all nursery stock is true to name and will replace
any portion of the stock that may prove otherwise. It is further agreed
that our liability in such instances is specifically limited to the purchase
price of such nursery stock.

All orders are C.O.D. unless specific terms have been confirmed by Ruppert
Nurseries, Inc. in writing. All orders must be paid within terms to qualify
for any discounts.

All orders are subject to crop and labor conditions and we reserve the right
to cancel a portion of the stock, or all thereof, should injury befall
our stock from hail, windstorm, frost or other weather conditions, insect
and disease injury or other natural causes that are beyond our control.

All cancellations must be made in writing and be received in a reasonable time
before the expected digging date. Cancellations will not be accepted after
stock has been dug or assembled. All cancellations are subject to a 10%
charge of the original order amount. No salesperson or representative is
authorized to alter these terms in any way unless confirmed in writing
by our office.

Errors made by Ruppert Nurseries, Inc. will be gladly corrected. Claims for
any cause must be made promptly upon receipt of plant materials. We will
not entertain claims after goods have been accepted.

All trees are machine-dug to the American Standard for Nursery Stock (ANSI
Z60.1) specifications, wrapped in burlap and placed in a wire basket. Hand-digging
is available for larger trees.

To ensure success, Ruppert Nurseries, Inc. uses the most advanced summer-digging
methods available. These may include trenching, watering, root stimulants,
anti-desiccants, pruning and oversized root balls. A surcharge of 20% may
apply for out-of-season digging. It is essential that post-shipment care
is given to this material by the purchaser including immediate watering,
proper pruning, prompt planting and maintenance.
